Specification
Basic Law.
Implementation of the registration of importers who will conduct activities in the field of customs imports, based on the provisions:
a.
Article 6A Act - Act No. 10 of 1995 on Customs ( Republic of Indonesia State Gazette Year 1995 Number 75, Supplement to the Republic of Indonesia Number 3612) as amended by Act - Act No. 17 of 2006 ( State Gazette of the Republic of Indonesia Year 2006 Number 93, State Gazette of the Republic of Indonesia Number 4661)
b. Regulation of the Minister of Finance of the Republic of Indonesia No. Tatalaksana 124/ PMK.04/ 2007 Importer Registration.
c.
Regulation of the Director General of Customs and Excise Tax on Tatalaksana P-34/ BC/ 2007 Importer Registration.
2. General Provisions.
For clarity and legal certainty in the implementation of registration, all parties to explain and agree on these things as follows:
a. Directorate General of Customs and Excise Department of Finance ( hereinafter referred DGCE) in carrying out the registration is done entirely by the Directorate of Audit, which is hereinafter referred to as the First Party.
b. Importers who will do the registration to DGCE to perform activities in the field of customs clearance of imports, which hereinafter referred to as the Second Party.
c. Importer Registration is the registration activities performed by the importer to DGCE to obtain Customs Identification Number.
d. Customs Identification Number ( NIK) is the identity number of a personal nature provided by DGCE to importers who have been doing the registration for or associated with custom systems that use information technology or manually.
e. Notice of Registration ( SPR) is the notice meets the registration requirements of importers NIK.
3. Registration Data Collection Procedures.
First Party provides charging facility registration data on the official website at the address DGCE www.beacukai.go.id and the Second Party perform charging and data transmission with the registration procedure as follows:
a. Both parties before filling the Form Registration Form must read first Charging Guidelines, print and study the Form Fields and tried charging off-line through the application program can fill didown form first loaded from the menu Importer Registration.
b. Both parties do Registration On-line by first read, understood and agreed Terms of Agreement, and fill in the registration charge of identity with a clear identity data and correct.
c. Both parties fill out Form Form completely and correctly with the data base and documents he had.
d. If all entries are complete, the Second Party perform field data electronically through the delivery that has been provided.
e. Both parties can see the response of data transmission on browsing menu / see the response of data transmission.
f. Both parties will get a response receipt number that serves as the identity ( ID) of the Second Party during the registration process.
g. First Party will always send a response and inform the results of the registration process for any registration data that is sent.
h. First Party will send the Notice of Registration either by e-mail address of the relevant importers or through post.
4. Rights and Obligations.
4.1. Rights and Obligations of First Party.
a. First Party Rights
* First Party has the right to receive, store, process and control all data that has been sent the Second Party
* First Party has the right to decide on the registration done, whether judged eligible, not eligible, conducted field research
* First Party has the right to revoke all decisions that have been given, according to national regulations
b. First Party Liability
* First Party is obligated to provide registration facilities on-line at the official site DJBC
* First Party shall provide responses and answers to all the data sent by the Second Party
* First Party is obligated to publish the SPR to the importer has met the requirements of importers and Order Administration
* First Party is obliged to publish the Notice of Registration Not Meet Conditions to the importer who has not or does not meet the requirements of importers and Order Administration
4.2. Rights and Obligations of Both Parties.
a. Second Party Rights.
* Both parties have the right to register and send the data electronically to the First Party.
* Second Party has the right to get a response and the response to Form Fields data has been sent.
* Second Party has the right to get the SPR they have completed the registration requirements.
b. Obligations of the Second Party.
* Second Party is obligated to fill in Form Fields with a complete and correct according to the data and documents he had.
* Second Party is obligated to send data electronically Form Fields and always monitor the registration response does First Party.
* Second Party is obliged to account for all the data and fields that have been sent to the First Party.
5. Emergency Force Majeure.
First Party and Second Party freed from all rights and obligations under this Agreement, in the case of incident or emergency and / force majeure which included:
a. Natural disasters, bad weather, war, riot and other things like that which resulted in disruption of data transmission facility electronically.
b. The presence and actions or policies of the authorities that could affect the sustainability of the registration process on-line.
c. Accidents, sabotage and other events beyond the planning and deliberate on both sides.
6. Other Provisions.
a. Each party agrees that this Agreement for any legal consequences are subject to applicable laws in the Republic of Indonesia.
b. If there is a dispute regarding the implementation of this Agreement, each party agreed to choose a permanent legal domicile and finish through the East Jakarta District Court in Jak
