Shipment Period;
The latest shipment date: 7 days after sellers get the LC from the buyer or negotiated with the seller and the buyer.

Further shipments:
If the buyer is satisfied with first shipment, then the buyer will buy at least 50000MT nickel ore per month from the seller.

PRICE; The Base Price shall be USD / WMT FOB MOTHER VESSEL, Pomalaa port, Indonesia, payable against irrevocable L/ C at sight.

TIME OF SHIPMENT; Within 30 days after received operative Letter of Credit, the shipment must be made. Laycan will be informed and agreed by both party. Buyer shall let Seller know 7 days in advance for the Laycan date and ships fixture note.
After finishing the loading, the seller should notify the buyer quality, quantity, the vessel’ s name, bills of lading, invoice, time of departure and estimated arrival date by fax.

PRICE ADJUSTMENT; The prices of Nickel Ore stipulated in Clause 5 shall be adjusted by the following:

1) If nickel content is 1.80% , the price will be USD / WMT, FOB Pomalaa port, Indonesia.
2) If nickel content is more than 1.80% , for every 0.01% Ni content up, the price will be increased with USD0.50/ WMT, FOB Pomalaa port, Indonesia.
3) If nickel content is less than 1.70% , the cargo will be rejected by the buyer.

MOISTURE:
1) If moisture is more than 30% , for every 1% moisture up, the price will be decreased with USD0.50/ WMT, fractions prorata.
2) If moisture is lower than 30% , for every 1% moisture less, the price will be decreased with USD0.50/ WMT, fractions prorata.
3) When the moisture content is more than 35% , Buyer has the absolute right to reject the cargo.

PAYMENT; Buyer must prepare the LC for Seller in 5 working days after signing of this contract, the buyer will open an
irrevocable non-transferable L/ C at sight covering 100% goods value in favor of seller from a prime bank.
The L/ C must be valid for 60 days after the B/ L’ s date.
